Introduction
Welcome to the Poras Chaudhary Fine Art Photography website (the “Site”). These Terms and Conditions (“Terms”) govern your access to and use of this Site, as well as any purchases of limited edition prints or other products through the Site. By using the Site or placing an order, you (the “Customer” or “Collector”) agree to be bound by the Terms outlined here. If you do not agree with any of these conditions, please refrain from using the Site. We reserve the right to update or modify these Terms at any time without prior notice, so we encourage you to review this page periodically. Your continued use of the Site after any changes indicates acceptance of the new Terms.

Artist and Studio Identification
This Site is owned and operated by Poras Chaudhary, an independent photographer and artist based in Haryana, Northern India. In these Terms, the terms “we”, “us”, or “our” refer to Poras Chaudhary (doing business as Poras Chaudhary Photography and Prints by Poras). The term “you” refers to any user or visitor of the Site, including buyers of our products.

1. Fine Art Prints – Editions and Authenticity

Limited Editions: All photographic prints sold on this Site are limited edition fine art prints, unless explicitly noted as an open edition. Each limited edition print is limited to a maximum of 10 pieces worldwide (plus up to 2 artist’s proofs) for each image. Once an edition sells out, no further prints of that image in that edition will be made available. Each print is individually inspected, hand-signed and numbered by Poras Chaudhary, and comes with a Certificate of Authenticity that is also hand-signed. The certificate and print will detail the title of the work, the edition number (e.g., 5/10), and the year of printing. We guarantee the authenticity of every print you purchase.

Open Editions: In the event that we offer open edition prints or reproductions (for example, smaller art prints, posters, or other merchandise), those will be clearly labeled as such. Open edition prints are not limited in number and typically are not signed or numbered. Unless stated, assume all prints on this Site are limited editions.

Print Materials: We take pride in the quality of our artwork. Prints are produced on archival fine art paper(Hahnemühle Photo Rag® 308 gsm or comparable museum-grade paper) using high-quality pigment inks. This combination is rated to last well over a lifetime under proper care. Minor variations: please note that due to differences in screen calibration and lighting, the colors of the actual print may vary slightly from what you see on your device. We strive to make sure the on-screen images accurately represent the final prints, but subtle differences can occur. These are not considered defects but are part of the nature of translating digital images to print. Rest assured, every print is vetted for color fidelity and overall appearance by the artist before it’s delivered.

2. Orders and Payment

Placing an Order: To purchase a print, select your desired image, size, and any available options, then follow the checkout process. By placing an order, you are making an offer to buy the selected product(s) in accordance with these Terms. All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order at our discretion, for example, in cases of obvious errors (such as a mispriced item), or if the edition is no longer available. If we refuse an order, any payment received will be fully refunded.

Payment: Prices are listed in the Site’s designated currency (we may offer multiple currency options). We accept major credit cards and other payment methods as indicated at checkout. Payment is required in full at the time of order. All transactions are processed through secure third-party payment gateways; we do not store your credit card details on our servers. In case of payment issues (e.g., credit card denial, fraud alert), we may reach out to you to resolve the issue, but we will not consider the order accepted until payment is successfully processed.

Taxes: The product prices listed do not include any applicable taxes (such as sales tax, VAT, GST) unless otherwise stated. If taxes are required by your region or country, they will be calculated and added at checkout in accordance with the law. For international orders, as noted in our Shipping policy, you are responsible for any import duties or taxes that your local customs office may impose upon delivery. These are not collected by us at checkout.

Order Confirmation: Once you place an order and payment is received, you will get an email confirmation summarizing your purchase. This email is your receipt and order confirmation. Please review it and contact us immediately if you notice any mistakes (such as an incorrect shipping address or size choice). The confirmation means we have received your order; it does not guarantee acceptance if we later find any issue (though such cases are rare).

Changes to Orders: If you need to modify or cancel your order, please contact us as soon as possible. Because we typically begin processing (or printing) orders quickly, we cannot guarantee that changes can be made after the order is placed. If printing has already started or the item has shipped, modifications may not be feasible. However, we will do our best to accommodate reasonable requests.

3. Shipping, Delivery, and Risk of Loss

Shipping Process: We handle and ship prints as described in our Shipping Information section. We will notify you when your order is dispatched and provide tracking. You are responsible for providing a correct and deliverable shipping address at the time of order. If a package is returned to us due to an incorrect address or unclaimed parcel, we will contact you for an updated address and additional shipping payment (if applicable) to resend it.

Delivery and Risk: We insure all shipments for their value during transit. The risk of loss or damage to the product passes to you once the package is delivered to your specified address (or when received by you in person). If a package is lost in transit or arrives damaged, please refer to our Returns policy for instructions on how to proceed – we will assist in remedying the situation. If tracking shows an item as delivered but you have not received it, let us know immediately so we can help investigate with the courier. Please be aware that once delivery is confirmed to the address provided, we may require you to follow up with local authorities or the carrier for stolen packages, as our insurance typically covers only until delivery confirmation.

International Shipping: As mentioned, international buyers are responsible for customs clearance and any import duties/taxes. Delays in customs are outside our control. We will provide any documentation needed (such as certificates of origin or invoices) to facilitate customs processing. Ensure that the item is not prohibited in your country (fine art prints are generally not restricted, but it is your responsibility to know any unusual import rules). We are not liable for packages delayed or returned by customs, but we will assist in resolving issues if they arise.

Force Majeure: We are not responsible for delays or failures in delivery caused by events beyond our reasonable control – such as natural disasters, strikes, wars, epidemics, or transportation disruptions. That said, if such an event occurs, we will communicate with you about the status of your order and do our best to deliver as soon as conditions allow. No refunds will be issued due to shipping delays out of our control, but we will extend our assistance to track and ensure eventual delivery.

4. Returns and Refunds

By purchasing a print, you acknowledge that the work is being made-to-order for you, and thus all sales are final. We do not accept returns, refunds, or exchanges for change of mind or personal taste reasons. We provide ample information and support prior to purchase to help you make an informed decision. If you have any uncertainties, please contact us beforebuying.

Damage or Defect: If the product you receive is defective or damaged, our obligation is to replace it with a new print of the same image and edition (or to refund you if a replacement is not possible, at our discretion). You must inform us of any issues within the timeframe specified in our Returns policy (generally within 5-7 days of delivery, with photographic proof). We will not consider claims made after a reasonable period, as we assume the print arrived in good condition if not promptly noted otherwise.

Return Procedure: Do not send any item back without contacting us first and receiving return instructions. In cases of damage or defect approved for return, we will likely provide a prepaid shipping label or coordinate pickup. The item must be packed in its original packaging (or equivalent) to avoid further damage. Once we receive the returned item, we will inspect it and then process the replacement or refund as agreed. Please note: slight variations in color or minor paper grain differences are not considered defects but normal aspects of fine art printing.

Exchanges: As noted, exchanges are not offered for limited edition prints. Each edition is unique and we cannot swap one image for another once production has occurred. If you wish to purchase a different image, it would be a separate transaction. In certain customer service situations, we may issue a credit as a gesture of goodwill, but that is at our sole discretion and will typically apply only toward future purchases.

Refunds: Refunds are generally only issued in the case that we cannot fulfill your order (for example, if the last print of an edition was sold simultaneously to another collector due to a website error, or if a print is lost and no replacement is possible). In such rare cases, we will promptly refund any payment made. Refunds, if granted, will be processed to the original payment method. Please allow some time for the refund to appear on your statement (this can vary depending on your bank or credit card).

5. Intellectual Property and Usage Rights

Copyright of Images: All photographs and content on this Site are © Poras Chaudhary (all rights reserved). Purchasing a fine art print does not transfer copyright or reproduction rights of the image to you. You are acquiring the physical (or in some cases digital) embodiment of the art for personal display purposes only. The images may not be reproduced, copied, scanned, distributed, or used for any commercial purpose without explicit written permission from the artist. This includes using the image for promotional materials, on websites, or creating derivative works. We actively protect our intellectual property. If you are interested in licensing an image for editorial or commercial use, please contact us for a separate licensing agreement.

Website Content: The design, text, graphics, logos, and overall look-and-feel of the Site are also protected by copyright and trademark laws. You may not use our site content for any purpose other than personal, non-commercial use without permission. For example, you are welcome to share a blog post link or an image on social media with proper credit, but you may not scrape our gallery images to sell prints yourself or use our text descriptions as your own.

User Conduct: You agree to use the Site for lawful purposes only. You shall not upload or transmit any content that is harmful, obscene, threatening, defamatory, or otherwise objectionable. You shall not attempt to gain unauthorized access to any part of the Site or its systems, or introduce any malicious software. Any such violations may result in termination of your access to the Site and possible legal action.

6. Limitation of Liability

Poras Chaudhary Photography (and any assistants, employees, or agents) shall not be liable for any indirect, incidental, special, or consequential damages that result from the use of, or inability to use, this Site or the products purchased from this Site. This includes, but is not limited to, reliance on any information obtained from us, mistakes, omissions, interruptions, deletion of files, viruses, delays in operation, or any failure of performance. Our total liability in respect of any claim arising out of or relating to a print or your use of the Site shall not exceed the amount you paid for that print or service.

In plain language: we will of course deliver the product you purchased, as described. We stand behind our art and will take care to address any issues within our control (like replacing a damaged print). However, we cannot be responsible for things outside our control, and our website is provided on an “as is” basis. If something goes wrong that is our fault, our remedy to you will typically be to fix it (e.g., sending a new print or refunding the transaction). We will not additionally compensate for inconvenience or other costs. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you fully – they apply to the maximum extent permitted by law.

7. Indemnification

You agree to indemnify and hold harmless Poras Chaudhary, his business, affiliates, and agents from any claim, loss, demand, or damage, including reasonable attorneys’ fees, arising out of your violation of these Terms or your infringement of any intellectual property or other right of any person or entity. This basically means if you misuse the Site or our content in a way that causes harm or legal issues, you’ll be responsible for the consequences, not us.

8. Governing Law and Dispute Resolution

These Terms and any separate agreements whereby we provide you services or products shall be governed by and construed in accordance with the laws of India. As the artist is based in India, you agree that any disputes (contractual or otherwise) will, to the extent permitted by law, be subject to the exclusive jurisdiction of the courts of India. We truly hope that no dispute ever arises – and we are committed to resolving any issue amicably through dialogue. If you have any concern or dissatisfaction, we encourage you to contact us first to seek a mutually agreeable solution before pursuing any legal remedy.

9. Miscellaneous

Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall nevertheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such a determination shall not affect the validity and enforceability of any other remaining provisions.

No Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Even if we don’t act immediately on a violation by you, we still have the right to enforce it later.

Entire Agreement: These Terms, along with any policies posted on this Site (such as the Privacy Policy and the Shipping/Returns information), constitute the entire agreement and understanding between you and us governing your use of the Site and purchase of products, and supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including any earlier versions of the Terms).
